Welcome to the Australian Local Food System Policy Database. This is a collection of policies from New South Wales (NSW) and Victorian local governments that relate to healthy, sustainable, and equitable food systems.

Street Activities 5 Mobile Food Businesses 5.1 5.2 5.3 Council approval is required for a person or business to undertake a mobile food business on public roads and public car parks in accordance with the Street Activities Code of Practice. Council will not approve the undertaking of mobile businesses that provide other goods or services on public roads (including footpaths) and public car parks. Approvals will be issued for mobile food businesses to park for a temporary period in public car parks and to intermittently stop on roads where the speed limit does not exceed 50kph and not within school zones. For the purposes of this Policy, the terms “temporary” and “intermittent” refer to the period of time the operator is engaged in serving a customer or customers. 5.4 Approvals will not be issued for mobile food businesses to operate in locations within 250m of an established shop, stall, sportsground or market/ festival selling similar goods when it is open for trading. Street Activities Policy Streatrader Streatrader is the online system for community groups and businesses to register their temporary and mobile food premises with their principal council, and notify the council where they will temporarily operate. If you sell food or drink in Maroondah, at a stall, tent, marquee or from a mobile food vehicle including a van, trailer or cart you must obtain a Streatrader permit. Street Stalls and Raffles Food-safety programs for stall holders To manage Council’s responsibilities under the Food Act 1984 as well as to ensure that our community is protected, an online system known as “Streatrader” has been developed to ensure all food traders (Business and Community Groups) register their temporary/mobile food premises under the statewide single registration system. Once registered, you must lodge a SOT (Statement of Trade) at least five (5) days before trading with the Council in whose areas you are planning to trade. This can be done in Streatrader. You can lodge a SOT at the same time as you register or notify your temporary or mobile food premises if you know the dates you plan to trade. You should allow 21 days for the registration/notification to be processed. ** You cannot trade until your premises has been registered/notified**. Streatrader automatically sends a copy of each SOT to your principal Council, to make sure it knows when and where trading is taking place. You can go back into Streatrader at any time to lodge new SOT’s as new trading activities are planned. STREET STALLS AND VENDORS POLICY 7. Stalls on Roadsides 7.1 Stalls must not be located where the speed limit is 80 km/h or higher unless safety and efficiency of road use by both vehicles and pedestrians is not compromised. 7.2 Stalls must not be located on a hill or bend where sight distance is limited. 4 Street Stalls and Vendors Policy the free passage of pedestrians, especially children, people with prams, the elderly and people with disabilities, including wheelchair users. Street Trading 6.5 Place activation, special events, festivals and community celebrations Place activation initiatives, festivals or events such as Fishers Ghost and Ingleburn Alive are community events or initiatives that are coordinated by the Council for the whole community. Street stalls during these events or initiatives are permitted to sell commercial products (other than prohibited items listed in Section 6.1.1) and prepared food. STREET TRADING 2. Street Vending Vehicles/Stalls There are two categories of approval given to this class of street trading. a) Standing Vehicle /Stall– This includes any vehicle/stall, whether registered or not, which is stopped on a public road or a public place for the purpose of selling any article. b) Mobile Vehicle This includes a stall in a fixed location or registered vehicle plying on public streets and making brief intermittent stops for the hawking of ice-cream, confectionary, seafood, fruit and vegetables, raffles, market days and the like. Approval for both categories of street vending may be granted under the Local Government Act Section 68 PART F (7) “Use a standing vehicle or any article for the purpose of selling any article in a public place”. Approval to operate a mobile street vending vehicle also requires compliance with the Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999 and Road Transport (Vehicle Registration) Regulation 2007. Street Trading Except for Community Event stalls (or as otherwise permitted in this Policy, refer to Part 4, subsection 8), the sale of food is restricted to pre-packaged food only and must include labelling in accordance with the Food Standards Code (Food Standards Australia and New Zealand). Food that requires temperature control is not permitted to be sold or distributed other than at approved "community event" stalls. Street Trading In accordance with the Australia New Zealand Food Standards Code in particular 3.2.2 Food Safety Practices and General Requirements Division 5 Cleaning, Sanitising and Maintenance, Clauses 19-21, all food businesses must maintain all fixtures, fittings and equipment to ensure there is no accumulation of food waste, dirt, grease or other visible matter.
